WHICH INDIVIDUALS ARE ABLE TO SHARE INFORMATION VIA
MESSAGES POSTED ON THE CLUB'S FORUM AND, BY EXTENSION,
THE CLUB'S WEBSITE GENERALLY.
FOR LEGAL
REASONS, WE CANNOT NOR DO WE TRY TO CONTROL THE INFORMATION
PROVIDED BY THIRD PARTIES WHICH IS MADE AVAILABLE
THROUGH THE CLUB'S FORUM AND/OR THE CLUB WEBSITE INCLUDING,
BUT NOT LIMITED TO, THE MATERIALS AND THE PRODUCTS.
THE CLUB PLAYS NO PART WHATSOEVER IN THE GENERATION

Terms
and Conditions of Posting
This agreement
(the "Agreement") between you and The West Coast Soaring
Club (the "Club") is effective immediately upon you
posting any information, content, views, advice, opinions,
statements, graphics, recommendations, services, offers
or advertisements (collectively, the "Materials")
on the Club's website, and may be amended and supplemented
at any time by the Club posting the amended and supplemented
terms and conditions on the Club's website.
Such amended and supplemented terms shall be posted
by the Club and shall automatically be effective three
(3) days after they are initially posted on the Club's
website. This Agreement may not otherwise be
amended, except in writing consented to by both parties.
You represent,
warrant, covenant, agree and undertake (as applicable)
as follows:
•
that the Materials that you post on the Club's website
are true, accurate, correct and complete;
•
that you are solely responsible for the Materials
posted by you on the Club's website and the Club and
the Club's website act as a mere conduit for your
online distribution and publication of your Materials;
•
that your Materials: (i) will not infringe any third
party's copyright, patent, trademark, trade secret
or other proprietary right or rights of publicity
or privacy; (ii) will not violate any law, statute,
ordinance or regulation; (iii) will not be defamatory,
libellous, abusive, vulgar, hateful, harrassing, obscene,
sexually oriented, invasive of a person's privacy,
or unlawfully threatening; (iv) will not be false,
inaccurate or misleading; (v) will not be provided
for any business purpose; (vi) will not contain any
viruses, Trojan horses, worms, time bombs or other
computer programming routines that are intended to
damage, detrimentally interfere with, surreptitiously
intercept or expropriate any system, data or personal
information;

that you will not use any device, software
or routine to interfere or attempt to interfere with
the proper working of the Club's website or any activities
being conducted on the Club's website; and
•
that you will comply with all applicable laws, statutes,
ordinances and regulations regarding your use of the
Club's website.
You acknowledge
and agree that the Club may, in its sole discretion,
add, delete, modify, amend or change some or all of
the content of the Materials at any time and from
time to time as it may determine is necessary or advisable
for the purpose of protecting the integrity of the
Club's website.
YOU FURTHER
AGREE TO INDEMNIFY AND HOLD HARMLESS THE CLUB AND
THE CLUB'S DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS,
AGENTS, REPRESENTATIVES AND ITS PARTNERS FROM ANY
LIABILITY, CLAIMS, DAMAGES, AND COSTS INCLUDING, BUT
NOT LIMITED TO, REASONABLE LEGAL FEES, ARISING OUT
OF OR IN CONNECTION WITH A BREACH OF YOUR OBLIGATIONS,
REPRESENTATIONS AND WARRANTIES PROVIDED IN THIS AGREEMENT.
YOU UNDERSTAND
AND AGREE THAT THE USE OF THE CLUB'S WEBSITE IS AT
YOUR OWN RISK AND THAT THE CLUB DOES NOT MAKE, AND
EXPRESSLY DISCLAIMS, ANY WARRANTY, TERM OR CONDITION,
EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, AS TO
THE USE OF THE CLUB'S WEBSITE TO BE PROVIDED OR WITH
RESPECT TO ANY POSTINGS PURSUANT THERETO INCLUDING,
BUT NOT LIMITED TO, ANY WARRANTIES OF SATISFACTORY
QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT,
OR ANY WARRANTY THAT THE CLUB'S WEBSITE WILL BE UNINTERRUPTED
AND ERROR-FREE.
IN NO EVENT
SHALL THE CLUB OR THE CLUB'S DIRECTORS, OFFICERS,
EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES AND
ITS PARTNERS BE LIABLE FOR LOST PROFITS, LOST SALES,
LOST BUSINESS, LOST OPPORTUNITY, LOST INFORMATION,
LOST OR WASTED TIME OR ANY SPECIAL, INCIDENTAL OR
CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING
NEGLIGENCE) ARISING OUT OF, OR IN CONNECTION WITH,
THIS AGREEMENT.
IT IS EXPRESSLY
UNDERSTOOD AND AGREED TO BY THE PARTIES HERETO THAT
EXCEPT AS SPECIFICALLY PROVIDED HEREIN, ALL WARRANTIES
ON THE PART OF THE CLUB, EXPRESSED OR IMPLIED, INCLUDING
ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS
FOR A PARTICULAR PURPOSE, ARE HEREBY EXCLUDED.
